We all know how popular ChatGPT has become these days, and yes, it was started by the OpenAI company. Though many of you may not know this, it was actually Elon Musk and Sam Altman who started this company together almost 10 years ago. It is possible that you have heard of the fact that this company had one goal, which was to create AI that helps everyone, no matter rich or poor, or those big companies out there. From the very start, the duo of Elon Musk and Sam Altman made OpenAI a non-profit so that nobody could own it and profit off of it in the future. But at this point, in 2025, OpenAI is getting exactly into that, and that is precisely why we are seeing this Elon Musk Openai For-Profit Lawsuit.

For some reason, Elon Musk actually left OpenAI back in 2018, but the company kept on growing and they finally launched ChatGPT in 2022 for everyone to use. Right off the bat, ChatGPT was a hit in the world, and the company started pulling in big money. But they were actually expecting this, and that’s why, back in 2019, the people behind this company created a new structure called the “capped-profit” model. Which means, they’ll still stick to the main goal of the company but will allow some investments.

That wasn’t it though, if you’re unaware of it, well, we’d like to tell you that right now, in 2025, OpenAI wants to go even further with this profit model, you see, the want to change into something else to bring in more profits and more investments, and they want to call it a Public Benefit Corporation. That’s like a company that is for-profit, but they also want to do good for the world.

Up until this point, there were no lawsuits, but since OpenAI tried to make this new move in 2025, we saw the Elon Musk Openai For-Profit Lawsuit right away.

OpenAI Fires Back: “You’re Just Jealous”

Sure, Elon Musk has filed this lawsuit, saying that OpenAI is not sticking to its true mission, but instead of admitting that they’re doing that, OpenAI is actually firing back at Elon, saying that “You’re just jealous!”

Jealous? How? Well, the company is saying that Elon Musk is using “bad faith tactics” to ruin the reputation of their business because he also owns his own AI company, and he is doing this because they’re practically competitors in this AI space.

Courtroom Drama And Elon’s Big Billion-Dollar Offer

This lawsuit is officially filed, and that’s why the judge, Yvonne Gonzalez Rogers, has set the first trial date for March 2026. Though Elon Musk actually wanted the judge to order OpenAI to stop making any changes to the profit model, she has refused so far. And then, in February 2025, we saw Elon Musk actually offer a $97.4 billion deal to buy OpenAI. You know how Sam Altman responded? He said: “No, thank you, but we’ll buy Twitter for $9.74 billion if you want.”
